User Generated Content

1. Definitions

“User Content” means any images, photographs, text, names, likenesses, logos, designs, or other materials uploaded or submitted by a customer for the creation of custom trading cards or related products.

“Club Decks” means ClubDecks Limited (or trading name), registered and operating in the United Kingdom.

2. User Content & Rights Warranty

2.1 Customers may upload User Content solely for the purpose of producing customised products.

2.2 By uploading User Content, you represent and warrant that:

  • you own the User Content or
  • you have obtained all necessary rights, licences, consents, and permissions required under UK law to use the User Content for printing and reproduction, including (where applicable):
    • copyright permissions (Copyright, Designs and Patents Act 1988)
    • trademark permissions (Trade Marks Act 1994)
    • consent from any identifiable individual featured in the User Content

2.3 You further warrant that the use of the User Content:

  • does not infringe intellectual property rights
  • does not give rise to a claim in passing off
  • does not breach privacy, confidence, or data protection laws
  • does not imply endorsement, sponsorship, or association without authorisation

3. Prohibited Content

3.1 You must not upload User Content that:

  • infringes copyright, trademarks, design rights, or database rights
  • infringes the rights of sports leagues, teams, clubs, governing bodies, or athletes
  • constitutes passing off under UK common law
  • misrepresents affiliation, endorsement, or approval
  • is unlawful, defamatory, obscene, or otherwise objectionable

3.2 Club Decks reserves the right (but is not obliged) to refuse, suspend, cancel, or remove any order or User Content at its sole discretion.

4. Responsibility for User Content

4.1 Club Decks does not claim ownership of User Content.

4.2 You acknowledge and agree that you are solely responsible for:

  • the legality of the User Content
  • obtaining any necessary licences or permissions
  • any consequences arising from the reproduction or distribution of the User Content

4.3 Club Decks does not verify ownership or licensing of User Content and relies entirely on customer representations.

5. Neutral Platform Disclaimer

5.1 Club Decks acts as a neutral service provider that produces customised products based solely on customer-submitted content.

5.2 Club Decks does not:

  • endorse or sponsor User Content
  • authorise the use of any protected sports branding or likenesses
  • claim affiliation with any sports organisation or individual unless expressly stated

6. Indemnity

6.1 You agree to indemnify and hold harmless Club Decks, its directors, officers, employees, contractors, and suppliers from and against all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to:

  • your breach of these Terms
  • your User Content
  • any allegation that the User Content infringes copyright, trademarks, design rights, or gives rise to passing off
  • any claim relating to unauthorised use of a person’s name, image, or likeness

7. Limitation of Liability

7.1 Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation
  • any liability that cannot be excluded under UK law

7.3 Club Decks’ total liability shall not exceed the amount paid by you for the relevant order.

8. Takedown & Cooperation

8.1 Club Decks reserves the right to:

  • suspend or cancel orders subject to intellectual property complaints
  • remove User Content where infringement is alleged
  • cooperate with rights holders or legal authorities where required

8.2 Customer details may be disclosed where legally required.

9. No Licence Granted

9.1 Club Decks does not grant any licence or permission to use:

  • sports league names or logos
  • team branding
  • athlete names or likenesses
  • registered trademarks

9.2 Customers are solely responsible for determining whether their use requires a licence or falls within lawful personal use or parody.

10. Governing Law & Jurisdiction

10.1 These Terms are governed by and construed in accordance with the laws of England and Wales.

10.2 The courts of England and Wales shall have exclusive jurisdiction.
